The rules for using Virtual Closet.

Plain-English terms covering what we agree to provide, what we ask of you, and how things end if either of us walks away. Read alongside our Privacy Policy.

1. Agreement

These Terms of Service ("Terms") form a binding agreement between you and Robert Sears, the independent developer of the Virtual Closet mobile application and any related services (collectively, "Virtual Closet", "we", "us"). By creating an account or using Virtual Closet you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the app.

2. Who can use Virtual Closet

You must be at least 13 years old to use Virtual Closet, and old enough to enter into a binding contract in your jurisdiction. If you are between 13 and the age of majority where you live, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

Virtual Closet is currently available primarily to users in the United States. We may add or restrict regions over time.

3. Your account

You may sign in with an email address and password, with Google Sign-In, or with Sign in with Apple. You are responsible for keeping your credentials secure and for any activity that happens under your account. Notify us promptly if you suspect your account has been accessed by someone else.

You may close your account at any time from the Profile tab — tap your avatar and choose "Delete Account." Deletion is permanent and removes your server-side data within 30 days, including any end-to-end encrypted cloud backup we hold for you (with limited routine backup persistence as described in the Privacy Policy).

3a. Cloud backup

Virtual Closet offers an end-to-end encrypted cloud backup of your closet (clothing items, outfits, calendar events, wishlist, and trips). The backup is on by default; you can disable it at any time in Profile → Cloud backup. When backup is on:

Photos you import, descriptions you write, outfits you log, calendar events you create, and every other piece of content you put into Virtual Closet — your content — remain owned by you. We do not claim any ownership over it.

You are responsible for your content. You confirm that you have the right to use any photo you import, and that nothing you add to Virtual Closet violates anyone else's rights or any law that applies to you.

5. License you grant us

To operate the features you choose to use, you grant Virtual Closet a worldwide, non-exclusive, royalty-free license to host, store, transmit, display, and process your content solely to provide the service to you and to the people you've chosen to share with. This license:

Virtual Closet uses AI providers (currently Anthropic for vision and text understanding, and optionally Replicate for image generation features you opt into) to power features like photo cataloging, outfit suggestions, and image "prettifying". When you use one of these features:

7. Friends and sharing

Virtual Closet includes features for adding friends, sharing specific clothing items, sharing calendar events, and borrowing items between users. When you share something with a friend, you are giving that friend access to view it inside their copy of Virtual Closet, subject to these Terms.

You may not share content of anyone other than yourself without their permission. We provide tools to block and remove other users — use them. We may, but are not required to, remove content that violates these Terms or applicable law.

9. Beta software notice

Virtual Closet is actively developed and may be offered to you through a beta channel (such as TestFlight) before reaching general availability. Beta builds may behave unexpectedly, may corrupt or lose data, and may change without notice. We do not guarantee compatibility between beta and production builds.

10. Disclaimer of warranties

Virtual Closet is provided "as is" and "as available", with all faults and without any warranty of any kind. To the maximum extent permitted by applicable law, we disclaim all warranties, express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that the service will be uninterrupted, secure, or error-free. You use Virtual Closet at your own risk.

11. Limitation of liability

To the maximum extent permitted by applicable law, Robert Sears will not be liable to you or to any third party for any indirect, incidental, consequential, special, exemplary, or punitive damages — including loss of profits, loss of data, loss of goodwill, business interruption, or cost of substitute services — arising out of or relating to your use of Virtual Closet, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, and whether or not we have been advised of the possibility of such damages.

In any event, our total cumulative liability arising out of or relating to these Terms or Virtual Closet shall not exceed the greater of (i) the amount you have paid us to use Virtual Closet in the twelve months immediately preceding the event giving rise to the claim, or (ii) US $50.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. In those jurisdictions, the above limitations apply only to the maximum extent permitted by law, and nothing in these Terms is intended to exclude any liability that cannot lawfully be excluded.

12. Indemnification

You agree to defend, indemnify, and hold harmless Robert Sears from and against any claims, damages, costs, and expenses (including reasonable attorneys' fees) arising out of (a) your content, (b) your use of Virtual Closet, (c) your violation of these Terms, or (d) your violation of any third-party right, including any intellectual property or privacy right.

13. Termination

You may stop using Virtual Closet at any time by deleting the app. To remove your server-side data, use the in-app "Delete Account" flow.

We may suspend or terminate your access to Virtual Closet at any time if you violate these Terms, if we are required to do so by law, or if continuing to provide the service to you would be technically or commercially unreasonable. We will use reasonable efforts to notify you, except where doing so would compromise an investigation, violate law, or risk harm to other users.

Sections that by their nature should survive termination — including ownership of your content, license back to us for content still in the service, disclaimers, limitation of liability, indemnification, and governing law — will survive any termination of these Terms.

14. Governing law and disputes

These Terms are governed by the laws of the State of New York, without regard to its conflicts-of-laws principles. Any dispute arising out of or relating to these Terms or Virtual Closet that cannot be resolved informally will be brought exclusively in the state or federal courts located in New York County, New York, and you and we consent to personal jurisdiction in those courts.

Before filing any claim, you agree to first contact us at thevirtualclosetapp@gmail.com and to attempt in good faith to resolve the dispute for at least 30 days.

You and we each agree that any dispute will be resolved on an individual basis only, and not as part of any class, consolidated, or representative action.

15. Changes to these terms

We may update these Terms from time to time. If we make a material change, we will update the effective date above and, where appropriate, notify you in the app or by email. Your continued use of Virtual Closet after a change indicates acceptance of the updated Terms.

Apple users. If you obtained Virtual Closet through the Apple App Store, Apple is a third-party beneficiary of these Terms and has the right (and accepts the right) to enforce them against you. The terms applicable to App Store apps that Apple imposes — including its Licensed Application End User License Agreement — also apply between you and Apple in addition to these Terms.
